Order 1 made by the primary judge in NSD 2384 of 2018 on 29 November 2021 be set aside and in lieu thereof it be ordered that the Respondent pay to the Commonwealth of Australia within 30 days a pecuniary penalty of $3 million pursuant to s 224 of the Australian Consumer Law (ACL), contained in Sch 2 to the Competition and Consumer Act 2010 (Cth), in respect of the contraventions of the ACL identified in Order 1 made by the Full Court on 27 August 2021.
